What Is It?
A child custody proceeding is any Family Court or Supreme Court proceeding where the residence of a child is at issue. The State or County, a parent, blood relative or non-relative may be a party to a custody proceeding and have an interest in the outcome. Court jurisdiction over custody issues is governed by the Uniform Child Custody Jurisdiction and Enforcement Act.
Who Needs Representation?
Any person seeking Court ordered custody of a child,
or seeking to prevent another person or representative of the state from
taking custody of a child. Litigation is often the result of a parent, relative
or state or county government asserting that it is physically or emotionally
dangerous for the child to remain in the custody of the person who then has
custody, or that it is in the best interest of the child to be in someone
else’s care, or that visitation with the child should be extended or denied
to someone.
